Obviously, while cigarette smoke is not healty, is economically healty to cash 80% of taxes on cigarette packs, and smoke which comes from factories, power plants and car's exhaust must be healty , therefore the need of not signing the Kyoto agreement.

So, americans have the right to be free from second hand cigarette smoke, but they don't, AND NEVER WILL have the right to be free from second hands Hummers smoke.
